Dr. S. Oyun, a doctorate in earth sciences from Cambridge University of UK is a Parliament member since 1998. She was a Minister of Foreign Affairs in 2007–2008.

Globus Medical Inc., Civil Action No. 1:10–cv–00849–UNA, U.S. District Court for the District of Delaware. On October 5, 2010, NuVasive, Inc. initiated a patent infringement lawsuit against Globus Medical, Inc. over Globus Medical’s LLIF lateral fusion offerings. NuVasive claims that these instruments, implants and techniques infringe on NuVasive’s XLIF intellectual property, specifically that disclosed within U.S. Patent No. 7,691,057. In fact, this is just the most current in a string of lawsuits NuVasive has levied against competitors such as Orthofix International and a counterclaim against Medtronic. These most recent assertions have only continued to bring NuVasive to the attention of a number of other market players in the space, including Medtronic.

Ulaanbaatar – 27 October, 2010–– M–ICP Policy recommendation which includes the necessity and importance of introduction of Trade –credit offset (TCO), technology and vendor qualification, a need for increased support for innovation, science and technology development and creation of necessary infrastructure for TCO and the use of intangible assets for loan collateral has been delivered to Mr. Ts. Bayarsaikhan, Chairman of Economic Policy Standing Committee of the Parliament today.

Trade–Credit Offsets: Experience of most countries using TCO showed that it contributes significantly to industry and infrastructure development and acceleration of economic growth, and increase country’s competitiveness, in particular it helps countries to increase its technology competence, to develop high value–added manufactured goods and create more jobs. The use of TCO can help our country to decrease the risk of Dutch decease by providing adequate support to development of manufacturing and agriculture sectors. The mechanism can be used for large investment projects such as Oyu Tolgoi, Tavan Tolgoi, building of power plants, copper smelters etc.

Technology and Vendor Qualification: The use of this service reduces the risk of importing low quality technologies from unreliable, dishonest and unethical suppliers and provides companies and the government to negotiate well with their negotiating parties based on high quality expert service on technology and vendor. This service is also important for above mentioned large projects.

Collateral enhancement: The modern banking service is increasingly becoming a system of collateral enhancement, not of credit enhancement nature. The introduction of this system through which banks can accept intangible assets as loan collateral based on expert advisory and underwriting service can help to modernize Mongolia’s financial system and it can help to create and or expand more businesses, more jobs and eventually it can lead to reduction of interest rates and less risky banking system.

22 October, 2010 –– Ms. D. Nergui was interviewed by Ms. A. Munkhnast, and Ms. B. Oyungerel, Mongolian National Chamber of Commerce and Industry today. The e–newsletter “IP Newsletter” will publish this interview in its upcoming edition on Innovation.

The MNCCI was founded as the “Chamber of Commerce” on 2 July 1960. Until 1990, in coordination with socialist system, the activities of the Chamber have organized the limited promotion of trade and industry as a quasi–governmental agency. The transition to a market economy gave the private sector effectual association within the Chamber. In the course of 45 years of history, the Chamber has conducted activities within an administration scope and acted independently for the last 15 years.

The first meeting of the Chamber affiliates was held in 1961 and 29 organizations were admitted as active members. Since the adoption of the “Law of the Chamber of Commerce and Industry” (1995), the Chamber’s activities have expanded both domestically and abroad. At present, the Chamber is the main representative body of the Mongolian business community and engages businesses, enterprises, and trade organizations in a wide range of activities and services in protecting common interests. CHARLOTTESVILLE, VA – October 21, 2010 –– M·CAM, Inc. released its Patently Obvious™ report today on US Pat. No. 5,251,294, which Webvention LLC purchased from Intellectual Ventures. The ‘294 patent describes a mouseover expansion feature that is common to many websites. Webvention, a non–operating entity based in Eastern Texas, claims to have licensed the ‘294 patent to 144 companies since its purchase from Intellectual Ventures. In addition, the company has filed two lawsuits since July accusing more than 35 companies of patent infringement. However, there are a handful of companies that will not surrender to the threat of antagonistic litigation. Novartis, TriMas, Instinet and Tenneco Automotive Operating Company have all filed counter suits asking that the patent be invalidated.

Microsoft, a 10 year veteran of mobile operating systems has stumbled in the space due to the failure of its Kin phone, forcing a reorganization of its consumer product unit. In a bid to regain lost ground in the mobile phone arena, Microsoft has put its vast resources behind the new Windows Phone 7 operating system. At the dawn of its release, Microsoft has filed a lawsuit against Motorola, who has yet to commit to the Windows Phone 7 platform. Microsoft claims that the handset OEM’s Android phones infringe nine of its patents.

CHARLOTTESVILLE, VA – October 13, 2010 –– M·CAM, Inc. released its Patently Obvious™ report today on the patent holdings of Mirror Worlds Technologies, Inc. highlighted in Mirror Worlds LLC v. Apple Inc., 08cv88, U.S. District Court for the Eastern District of Texas. Apple has historically been quite successful at predicting consumer preferences and has capitalized on their foresight to drive consumer demand. Their enviable position of success has opened the door to both legitimate and opportunistic lawsuits concerning their intellectual property. On March 14, 2008, Mirror Worlds, LLC sued Apple, claiming that CoverFlow infringed on four of its patents. More than two years later on October 1, 2010, Apple was found to have infringed on Mirror Worlds’ patents and was ordered to pay up to $625.5 million to the plaintiff ($208.5 million for each patent infringed). Ironically, during the course of the lawsuit proceedings, Apple was granted a patent on its CoverFlow interface. Apple is currently appealing the verdict.

Mongolia – October 12, 2010 ––The International Renewable Energy Organization /IREO/ in cooperation with the United Kingdom based, Humanitad international NGO, have chosen Mongolia as the very first Flagship Pilot Nation for their newly launched, Exemplar–Zero Initiative–carbon–zero, sustainable development global initiative. Mongolia was announced the Flagship Pilot Nation during the official inauguration of the E–Z Initiative, held in New York on October 10–11, 2010.

Among the participants were: Founder of Humanitad as well as IREO Director General, Mr. Sasha Stone; IREO Secretary General Mr. Robson Mello; Chairperson of the Economic Innovations Committee of IREO and CEO of M·CAM, Dr. David E. Martin; Senior Advisor to the President of Mongolia, Mr. Tsagaan Permanent Representative of Mongolia to the United Nations, Mrs. Enkhtsetseg and others.

The initiates of the Exemplar–Zero Initiative assures the just and moral business principle under which the initiative would be implemented. More specifically, through technological investments in domestic businesses, science and research centers and institutions, as well as by issuing license as a way of improving Mongolia’s technological competitiveness, the initiative would play a significant role in Mongolia’s effort for achieving sustainable development.
The Exemplar–Zero Initiative is supported by the private sector; where the objectives of the initiatives cover a number of clean and sustainable development methods in various areas. The E–Z Initiative aims to achieve improvements in: a drastic mitigation of carbon dioxide emission to the point of zero; better usage of surface water; water purifying and recycling; installing in various production process new technologies that require as less water as possible; finding and implementing a the optimum heat and power resource in rural areas; increasing the participation of domestic sectors in production and mining development process. Moreover, in order to decrease the environmental–damage done by mining industries, importing and effectively utilizing the most advanced technology in copper, gold and uranium development; while using the latest transportation and logistic equipments as a way of decreasing air–pollution caused by old and worn–out machines.

New-York – 10–11 October, 2010 –– Exemplar Zero which is the full spectrum sustainability initiative was launched in New–York, USA. The E–Z was initiated by the Humanitad, International Non–governmental Organization based in UK and the Inter–governmental Renewable Energy Organization (I.R.E.O), a United Nations affiliate IGO and is a private sector led initiative. Mr. Armand Assante, International Hollywood Actor and Activist who hosted the Millennium Development Goals Awards at the United Nations General Assembly in 2009 and again in 2010 MDG opened this event and Mongolia has been announced as Exemplar Zero’s Flagship Pilot Nation during this launch event. Mr. P. Tsagaan, Senior Advisor to the President, Ms. O. Enkhtsetseg, Permanent Representative of Mongolia to UN, Sasha Stone, Founder of Humanitad, Mr. Robson Mello, Secretary General of I.R.E.O, Dr. David E Martin, Chair of Economic Innovation Committee of I.R.E.O and Chairman of M·CAM, Ms. Nergui Dorj, M–ICP CEO and Mr. B. Byambasaikhan, Managing Director of New–com group, E–Z investors, partners and supporters participated in this inaugural event.

Within the framework of E–Z Initiative, a new economic and business model based on Ethical financial and economic policies will be used in identifying and deploying best–practice emission control and elimination technologies to reduce air pollution, for water re–cycling and waterless processes, in identifying and deploying best–in–class solutions for coal, copper, gold and uranium extraction and refinement to increase domestic participation in the commodity value chain and process these materials in best–in class environmentally suitable means.

CHARLOTTESVILLE, VA – October 6, 2010 –– M·CAM, Inc. released its Patently Obvious™ report today on the patent holdings of Dot Hill Systems and CommVault Systems. M&A activity in the technology sector continues to be white–hot in the wake of Hewlett–Packard’s acquisition of ArcSight and 3PAR. As in previous weeks, news of imminent rollups in the storage and security sectors has driven further speculation into the identity of the next impending targets.

One potential acquisition target which has been in the news is CommVault Systems (NASDAQ: CVLT). A spinoff from AT&T’s Bell Labs, CommVault, like 3PAR and Isilon Systems, specializes in data and storage management software. CommVault fits the profile of a potential acquisition target for information technology giants such as HP, Dell, or Oracle; Dell, especially, is incentivized to pursue acquisitions in the wake of its failed bid for 3PAR opposite Hewlett–Packard.

CommVault isn’t the only potential acquisition target, however. In fact, some of the more interesting targets haven’t yet popped up on the radars of the major tech sector analysts and forecasters. One of these companies is Dot Hill Systems (NASDAQ: HILL). M·CAM identified both CommVault and Dot Hill Systems, among others, though its proprietary analytical processes. Which entity seems to be a better acquisition target in today’s market, the “obvious” choice or the dark horse candidate? Mr. Chinbat expressed his office readiness to cooperate with M–ICP and M·CAM in number of areas, including the improvement of e–data base of IPOM. He also appreciated for M–ICP in partnership with M·CAM initiative to use intangible assets as loan collateral and mentioned that his office has tried to promote this in Mongolia for quiet sometime.
